The first charge is a serious felony that could result in up to five years in prison. The other two charges are less serious misdemeanors, each punishable by up to one year in jail according to Florida law. If convicted on all charges and given the maximum penalties, Doherty could be imprisoned for as long as seven years.
Police stated that Doherty seemed unconcerned during the interaction, which led to the resisting charge. Even after being arrested, Doherty has continued to stream online.
According to data from Measures for Justice, most people in Miami-Dade County convicted of nonviolent felonies with no prior record don’t end up in prison – less than 8.5 percent actually are sentenced there, despite over half being convicted. The typical sentence for these types of offenses is around 24 months, which could mean a potentially shorter sentence for Doherty if he is convicted.
This incident brings up important questions about what happens when someone is caught with a small amount of drugs or doesn’t cooperate with police. Many of Doherty’s supporters might be shocked to find out that even minor, non-violent offenses can lead to legal problems.
