Sean ‘Diddy’ Combs Asks To Vacate USD 100 Million Sexual Assault Default Judgement Filed By Michigan Prisoner

According to court documents obtained by People, Sean ‘Diddy’ Combs has submitted an urgent request to the court for the cancellation of a temporary restraining order, a preliminary injunction, and a previously granted default judgment.

On September 12th, Thursday, Diddy completed a filing, following a default judgment worth USD100 that was ruled against him in Derrick Lee Cradello-Smith’s lawsuit. This unfavorable decision came about due to his absence during the virtual hearing held on September 9th, Monday.

Judge Anna Marie Anzalone granted the judgment in favor of Cardello-Smith. In an attempt to overturn this default judgment, Cardello-Smith’s legal representative asserted that he is currently incarcerated due to a previous conviction for kidnapping and sexual assault.

Additionally, it’s been claimed that he has made “unfounded” accusations on various occasions before, and the assertion that the founder of Bad Boy Records sexually assaulted him in 1997 is widely considered as untrustworthy or implausible.

Additionally, the defense for the troubled musician maintained that the court-issued decision lacked validity based on Michigan Court Rule 2.105(A), as the rapper was not adequately notified about the legal proceedings.

According to Diddy’s recent legal filing, it was stated that he had no prior knowledge of this lawsuit until the public announcement of the $100 million default judgment against him. Furthermore, his legal team asserted that any delay in responding to the lawsuit was unintentional. Once Diddy became aware of the lawsuit, he promptly submitted a motion to nullify the judgment, as detailed in the court documents.

The filings additionally assert that the statements made by Cardello-Smith, which have been countered by the rapper in a sworn affidavit, are untrue, hard to believe, and riddled with “inconsistencies and outlandish claims,” such as the one stating he invested $150,000 for Diddy’s 49% net worth.

In simpler terms, the documents describing a $100 million verdict stated that it was exceptional and inconsistent with any real damage claims, even if every questionable accusation in the lawsuit were valid. The rapper, up until recently, had no knowledge of the lawsuit.

Additionally, the attorneys pointed out that the deadline for taking action on Cardello-Smith’s claims, as specified by the statute of limitations, expired in 2007. Therefore, regardless of the validity of his accusations, they may not be considered further.

The court documents show that the disgraced singer has requested to terminate a temporary restriction order or preliminary injunction. He argues that the person in question, Cardello-Smith, should not be granted an injunction and claims that the rapper was not properly served with the complaint, which allegedly infringes upon his constitutional rights.

The point was made that the decision was improper as Cardello-Smith didn’t assert an ownership stake in the property, but rather obtained a financial penalty against the defendant singer. Previously, the Michigan court decided that such a claim didn’t meet the requirements for granting relief in the injunction order.

As stated by Diddy’s legal representative, they argue that the court does not have authority over him since the signature on the return receipt is not authentic to him.

According to the Detroit Metro Times, the plaintiff submitted a complaint against the rapper Last Night in June. In August, a temporary restraining order was granted to prevent Diddy from selling any assets that might be used to compensate for potential damages to Cardello-Smith.

As reported by The Guardian, towards the end of that same month, Cardello-Smith stated that Diddly visited him in prison and proposed settling the lawsuit by giving him a sum of approximately USD 2.3 million.
