According to journalist Julien Tellouck, Genki’s representative admitted receiving a call from Nintendo’s lawyers. Nevertheless, Genki is confident they are not in danger since they haven’t entered into any confidentiality agreements or Non-Disclosure Agreements (NDAs) with Nintendo.
Nintendo consistently safeguards its creative works, taking steps like filing lawsuits against individuals and sites that share their video game files (like ROMs) without approval. Similarly, they take action against people trying to illegally tamper with or alter their gaming hardware.
Genki argues that their actions don’t breach any contracts with Nintendo because they made the replica using public information and their unique ideas. However, Nintendo considers these prototypes as unauthorized.
