
Kanye West, who now goes by Ye, is under fire again. His lawyers recently claimed that some of his antisemitic statements were actually expressions of his artistic creativity. They filed legal documents this week with a California court, hoping to stop a lawsuit alleging workplace harassment from proceeding.
A former marketing worker at Ye’s company has filed a lawsuit, alleging she was harassed while working to promote his album, Vultures 1, in 2024.
The former employee, who is Jewish, claims that Ye likened himself to Hitler, shared explicit content, and repeatedly used a highly offensive slur in text messages directed at her. Her lawyer stated when the lawsuit was filed that Ye engaged in a consistent and intentional pattern of antisemitism and sexism towards his client.
Ye issued a public apology in January for his antisemitic remarks, taking out a full-page ad in The Wall Street Journal. He explained that these hateful statements stemmed from a brain injury sustained in a car accident over 20 years ago, which wasn’t properly diagnosed until 2023. He was also diagnosed with bipolar disorder. In the ad, he wrote, “I am not a Nazi or an antisemite. I love Jewish people. … I regret and am deeply mortified by my actions and am committed to taking responsibility, getting treatment, and making real changes.”
Even after apologizing, Ye’s lawyers are now claiming that some of the statements he made to the former employee were actually a form of artistic expression. According to a recent legal document, his creative choices – including ideas, images, marketing plans, and decisions about who worked on his projects – weren’t separate from his art, but essential to its creation. They also assert that Ye isn’t just an artist, but is art itself, and that his actions are a deliberate, ongoing performance intended to push boundaries and question societal norms surrounding race, religion, gender, and politics.
The judge overseeing the initial case wasn’t convinced by Ye’s reasoning. They criticized the legal filing as being full of errors, weak arguments, and incorrect statements of the law. The judge also found that Ye’s witnesses didn’t have firsthand knowledge of the events and hadn’t properly established the basis for their testimony. As a result, Ye was ordered to pay $79,000 to cover the former employee’s legal fees – a bit less than the $99,000 requested.
So, the legal battle surrounding Ye is heading to the California Court of Appeals. The big question the judges will be tackling is whether his actions can be considered artistic expression and therefore protected, or if they actually constitute harassment. The person suing him is making a strong point: the First Amendment shouldn’t give a free pass to workplace harassment, even if someone claims it’s all part of their creative process. If the court sides against Ye on this appeal, we’re looking at the case moving forward and getting into the detailed phase of gathering evidence – discovery, as they call it.
Ye is also dealing with a lawsuit regarding a $57.3 million California property he purchased in 2021 that was later damaged. The lawsuit alleges Ye made someone live on the property constantly, which caused them harm. Both Ye and his wife, Bianca Censori, are scheduled to give testimony in court.
This situation brings up difficult questions about how far artistic freedom should go and who is responsible for the impact of art. Ye believes his personal life is part of his creative work, but many disagree and see this as a way to justify problematic actions. The courts now face the challenge of deciding how to balance the right to free expression with the need to protect employees from harassment.
