Harvey Weinstein’s Legal Team Pushes For Hospitalization Over Jail Time As Retrial Approaches

Harvey Weinstein was recently readmitted to Bellevue Hospital in New York City following an emergency heart operation. Prior to this, Weinstein, who has faced a series of health complications lately, had been moved from Rikers Island due to feelings of illness on September 8th.

As reported by NBC New York, his legal team stated that Weinstein underwent a procedure called pericardiocentesis the following morning to drain excess fluid surrounding his heart and lungs.

Weinstein’s team is aiming for him to remain in the hospital beyond the usual timeframe, hoping this would help manage his health issues throughout the upcoming trial. Curtis Rothfeld, one of his representatives, shared this intention with NBC New York.

The upcoming retrial for Weinstein, slated for November, intensifies the sense of immediacy regarding his present circumstances. Although his heart surgery seems to have improved his health, his legal team advocates for him to continue receiving medical attention.

It’s been made clear that Weinstein’s health problems are severe and continuous care is necessary, according to his representatives. In a statement to PEOPLE, Rothfeld and Engelmayer stated that Weinstein is dealing with several serious health concerns that demand ongoing attention. They expressed gratitude towards the New York City Department of Correction and Rikers Island for swiftly transferring him to Bellevue Hospital.

The planned re-trial for Harvey Weinstein on charges of rape and sexual assault is tentatively set for November 12, 2024. This schedule arises from the New York Court of Appeals ruling in April 2024, which overturned Weinstein’s 2020 conviction for rape.

In a 4-3 decision, the supreme court determined that the lower court made an error by permitting testimony from three women whose allegations against Weinstein were not included in the formal charges brought against him.

The forthcoming re-trial holds significant importance for Weinstein, as his 2020 verdict was considered a significant milestone in the #MeToo movement. Yet, there is doubt about whether Weinstein’s health permits him to take part in the court proceedings.

During a court session held on July 19, Judge Curtis Farber provisionally scheduled the new trial date. Earlier, during a hearing on July 9, Assistant District Attorney Nicole Blumberg suggested that additional accusations could surface during the upcoming trial, as further investigations into sexual assault allegations were ongoing.
