Genki to respond “thoughtfully” to Nintendo lawsuit

In the lead-up to Nintendo‘s reveal of the Switch 2, there was an intense period of leaks, rumors, and conjecture, partly ignited by a prototype console displayed at CES 2025 in Las Vegas by Genki, an accessory manufacturer. They had crafted this model to preview their upcoming product line for the yet-unannounced Nintendo hardware. When word got out about it, there was quite a buzz. In fact, Nintendo’s legal team even visited Genki’s booth at the event, but no action was taken at the time – until now.

2025 saw Nintendo taking legal action against Genki, claiming that they had violated trademarks, engaged in unethical competition practices, and made misleading advertisements.

According to court documents submitted by Nintendo, they claim that Genki started promoting they had access without permission to the forthcoming Switch 2 console, which Nintendo had been developing since 2019. Furthermore, Nintendo alleges that Genki deceived consumers by using trademarked symbols for their upcoming products, leading people to think they were offering genuine, authorized, and fully functional Nintendo Switch 2 products.

Since CES, Nintendo has effectively utilized the passing time by meticulously compiling a comprehensive chronology of events, which is backed by substantial proof in support of their assertions. Some of these points appear particularly damaging, especially considering their self-inflicted nature from Genki’s point of view.

Nintendo is seeking a legal order to prevent Genki from creating, showcasing, marketing, selling, producing, distributing, or endorsing any products related to Nintendo gaming systems, and they are also demanding compensation for the claimed harm inflicted by Genki.

Two days after the lawsuit was filed, Genki released a brief announcement, stating they are giving careful consideration to the matter and are collaborating with legal advisors to formulate a thoughtful response.
