Alec Baldwin’s Dismissed Charges in ‘Rust’ Case Challenged by Prosecutor’s Appeal; Deets Here

In her filing on November 21st, Special Prosecutor Kari T. Morrissey expressed intent to contest the dismissal of charges against Baldwin from July. The recently unveiled legal motion questions the judge’s decision to drop involuntary manslaughter accusations against the actor.

In July 2024, Baldwin’s charges were dropped because of problems concerning evidence concealment. Morrissey’s latest appeal aims to question a decision made in October that refused to re-evaluate the dismissal. Baldwin’s legal team is likely to vigorously resist this move, just as they have done with previous attempts to resume the trial.

On October 21, 2021, an unfortunate incident involving a gun occurred during a rehearsal. The gun in question belonged to actor Alec Baldwin and unintentionally discharged, leading to the death of cinematographer Halyna Hutchins and injuring director Joel Souza. Both Baldwin and armorer Hannah Gutierrez-Reed were initially charged with involuntary manslaughter. However, charges against Baldwin were later dropped, whereas Gutierrez-Reed was found guilty and sentenced to 18 months in prison earlier this year.

In a continuous effort to avoid accountability, Baldwin maintains he didn’t pull the trigger; however, findings from both the FBI and independent investigators suggest otherwise, indicating that the gun would not have discharged unless the trigger was indeed pulled. Facing a possible 18-month imprisonment if found culpable, this is the stance taken by Baldwin.

The situation has undergone various turns in the legal system, involving previous dismissals followed by re-filings. Morrissey’s appeal aims to contest that Baldwin’s defense misled the court with allegations of concealed evidence. Given their reputation for tough tactics, Baldwin’s lawyers are expected to concentrate on Judge Mary Marlowe Sommer’s decisions, as she has previously rejected efforts to rejuvenate this case.
