Miley Cyrus Faces Setback in Flowers Copyright Lawsuit Over Bruno Mars’ When I Was Your Man; Details Inside

In a recent decision regarding an ongoing legal dispute related to the Flowers copyright case, a judge has rejected Miley Cyrus’s attempt to drop the lawsuit. The actress from Hannah Montana had aimed to dismiss the claim that her 2023 song, Flowers, was a copy of Bruno Mars’ track When I Was Your Man.

Last September, the songwriter who is known for hits like “Party in the USA” was initially taken to court by Tempo Music Investments. This company earlier obtained the rights to the songwriting catalog of Philip Lawrence, a co-writer of “When I Was Your Man”.

It’s worth mentioning that neither Bruno Mars nor Philip Lawrence were listed as defendants in the legal matter. After the case was filed in September, Miley Cyrus submitted a request for its dismissal in November of the same year.

Yesterday, a judge refused to dismiss the case against me, setting the stage for the upcoming trial. In his statement, the judge indicated that there was a misinterpretation on my part, as well as that of my legal team, concerning the legal framework surrounding copyrights.

As reported by Variety, the judge additionally pointed out that Cyrus’s legal team contended that Tempo Music Investments lacked the authority to file a lawsuit against her. This was due to the fact that they obtained Lawrence’s rights to “When I Was Your Man” without first gaining approval from the other songwriters involved.

According to Miley Cyrus’s legal team, Tempo had infringed upon their ability to file a lawsuit. Yet, the judge determined that this claim was inaccurate and emphasized that Tempo possessed an “exclusive license” for the copyright.

According to the report, the decision indicates that Tempo has taken over Lawrence’s position and now shares ownership of the exclusive rights to the copyright with him.

The decision made clear that since Lawrence, being a co-owner, can take legal action for infringement, the same goes for Tempo. Alex Weingarten, Tempo’s lawyer, was pleased with the ruling and expressed that his client is optimistic about resolving the case.

Miley Cyrus’s Flowers was released in January 2023.
