As the court case involving the suit edges closer to a 2026 trial, there is now a heated dispute between the two parties regarding the level of transparency in court proceedings. The legal team representing Lively, managed by Willkie Farr & Gallagher, has accused Baldoni and his associates of misrepresenting the intent behind a proposed protective order (PO).
As reported by Deadline, the actress’s legal representatives argue that the opposing side has manipulated the request, using it as a means to make false allegations. The debate surrounding the protective order centers on whether lawyers should be the only ones with restricted access to confidential case documents. The actress’s team insists that this restriction is crucial for safeguarding witnesses and victims.
However, attorney Mitchell Schuster, representing Baldoni, argues that Lively’s team has been openly discussing the case with the media, making their call for privacy seem inconsistent or hypocritical. Schuster also trusts that standard court proceedings provide sufficient protection without the need for additional privacy measures.
In simpler terms, Michael Gottlieb, Lively’s lawyer, criticized the other side for showing a lack of care towards workplace protections against sexual harassment. He added that their stance, which suggests a woman speaking out against sexual harassment has given up any right to privacy, is disrespectful and demonstrates the pointlessness of further negotiations.

This is because parties (and possibly external parties) may endeavor to persuade the legal team for the Wayfarer Parties that women retain their privacy rights, even when they choose to voice their opposition against the Wayfarer Parties.

Additional lawsuits have been brought forth, such as a $7 million defamation lawsuit filed by PR consultant Jed Wallace against Lively. Concurrently, Leslie Sloane, Reynolds’ publicist, has formally requested to be excluded from the court proceedings.
