The judge’s statement reads, “The series implies that the plaintiff is a convicted criminal who sexually and violently assaulted Gadd. Such statements could potentially reach the threshold of extremely offensive behavior.
Klausner went on to say, “Though the actions attributed to the plaintiff are condemnable, the defendants’ remarks are even more offensive and might have a significantly different impact on an observer’s perspective.
Despite discarding Harvey’s allegations of negligence and breach of publicity rights, the judge permitted her to continue with the lawsuit based on the grounds of intentional infliction of emotional distress.
