To ensure that you can appreciate fan works without restriction, we’ve made some adjustments to our past policies. We’ve redefined the boundaries of commercial activities and set guidelines for sales, among other aspects.
This fresh set of guidelines has been crafted to empower creators, enabling them to explore fan content with more freedom and dynamism than previously thought possible. Don’t forget to consult the revised policies and keep sharing your fantastic work with our community!
The term ‘Game IP’ encompasses all the copyrights related to BrownDust2, which span across elements like the game’s setting, narrative, characters, monsters, artwork, background tunes, and video content.
In simpler terms, when it comes to any material using the Game IP, the copyright and all related intellectual property rights are owned by BrownDust2.
Under ‘Derivative Works‘, we’re talking about new creations that are based on the Game IP or are creative reinterpretations of BrownDust2 materials.
5) Simply copying the Intellectual Property of the game, like re-drawing it or similar actions, does not fall under the category of creating a Derivative Work.
6) Engaging in the development, dissemination, or maintenance of a game based on the Game Intellectual Property doesn’t fall under the category of Derivative Work Activities.
6) When disclosing Derivative Works, you must clearly credit BrownDust2 as the source.Â
For specific resources, such as music or videos, you must include a link to our official channel.Â
Certain Derivative Works, such as figures, must go through the appropriate licensing process.
7) Derivative works can be utilized for both non-profit and small-scale business purposes, as long as their use falls within these boundaries:
You’re allowed to post your Derivative Works on open content platforms like YouTube, Twitch, Kickstarter, etc., and make money from advertising revenue, viewer donations, or sponsorships. But, earning income in any other way is off-limits.
If a derivative work doesn’t breach Condition 8, it can be sold without additional restrictions. Usually, NEOWIZ or BrownDust2 won’t require you to submit your fan creation for pre-approval unless specifically asked.
Direct sales of derivative works are required by the creator. Creators can choose to sell their works either face-to-face or online, but they cannot distribute them via third-party vendors such as dealers, wholesalers, general distributors, or online marketplaces that buy items for resale. If you wish to sell through a third-party distributor, prior written approval from BrownDust2 must be obtained first.
iv. For online sales, you may sell up to 100 units per Derivative Work.
In simpler terms, if the Derived Work is a published piece like a doujinshi or a joint anthology, there are no limitations on conducting commercial activities with it.
Businesses planning to market Derivative Works using the Game IP from BrownDust2 should first secure written approval from BrownDust2. Neglecting this requirement could lead to BrownDust2 taking necessary actions, such as a formal demand to halt sales.
8) All Derivative Works must comply with copyright and relevant laws.Â
It’s essential that actions do not go against community values, moral principles, or societal norms. The following is a list of things absolutely forbidden in creating derivative works:
i. Content that could harm the reputation of BrownDust2
Content that breaks laws, invades people’s privacy, or uses someone else’s work without permission, such as copyrighted materials or personal images without consent.
Information that unfairly demeans, disrespects, or incites prejudice or hostility towards any particular community, religion, ethnicity, or gender.
iv. Content that is violent, disturbing, or graphic
v. Content that can be mistaken as official company content
vi. Any other content deemed inappropriate by BrownDust2
If any adaptations made using our game’s intellectual property (IP) breach these guidelines or relevant laws, BrownDust2 reserves the right to promptly revoke your permission to use the IP and take necessary actions. These actions may include deleting the infringing content, halting its distribution, or stopping its transmission.
10) All rights to the Game IP are reserved by BrownDust2.
This set of guidelines offers fundamental knowledge about making adaptations or extensions of existing works. Please note that these guidelines can be updated at any time without advance warning, and special conditions might apply in certain situations.
